Terms of Use

1. General

These Terms of Use govern the contractual relationship between Ziele-Setzen.com and users of the platform zielesetzen.com. By registering, users accept these terms.

By using or accessing our services, you agree to these Terms of Use and, where applicable, any product-specific terms, acceptable use policies, and data processing provisions (collectively, the “Agreement”).

If you do not agree with the provisions of this Agreement, you are not permitted to use or access our services.

2. Creating an Account

2.1 Registration

To use many of our services, you must first create a user account. You agree to provide truthful, complete, and up-to-date information during registration and use. We reserve the right to use this information to contact you if needed.

2.2 Security of Your Credentials

Please keep your login credentials (especially passwords) confidential and protect your account from third-party access. You are solely responsible for all activities that occur under your account and for safeguarding your passwords. We are not liable for any loss or damage resulting from unauthorized use of your account. If you suspect misuse, loss, or theft of your credentials, you must notify us immediately.

2.3 Minimum Age

Our services are intended exclusively for individuals aged 18 and over. By using the services, you confirm that you are at least 18 years old. If you are under 18, you are not permitted to use our services.

3. Content

As part of our services, you can define personal goals and, to support adherence, choose a refundable monetary commitment. This amount serves as motivation to achieve the goal and—subject to the conditions below—is fully refunded upon successful goal completion.

3.1 Goal Definition

You must define a personal goal that serves as the basis for the commitment and for later evaluation of success. Goal definition is central to the use of the service and is subject to the following requirements:

  • Clarity and specificity: Your goal must be concrete, unambiguous, and understandable. Vague intent statements (e.g., “I want to get fitter”) are insufficient. A precise formulation is required (e.g., “My goal is to run a marathon”).
  • Measurability: The goal must be described in measurable terms (numbers, frequencies, facts, time periods, etc.; e.g., “Lose 5 kg by June 1” or “Meditate daily for 30 days”).
  • Realistic and achievable: The goal must be realistic and reasonable; unhealthy or unrealistic goals may be rejected.
  • Exclusions: A goal must not have the character of a wager. The outcome must depend, with sufficient certainty, on the goal author’s actions. Defining goals for third parties is not permitted.
  • Changes/adjustments: Changes to the goal definition after checkout are generally excluded—for questions or issues, please contact support@zielesetzen.com.

3.2 Deadlines and Evidence Requirement

For each goal, you must set an individual deadline for completion, with a maximum of 170 calendar days from the start of the goal. You must also set a deadline for submitting suitable evidence, which must fall within the maximum period. Goal completion is considered successful only if evidence is submitted on time and in a verifiable, understandable form. If no timely evidence is provided or it is insufficient, the goal is deemed not achieved. Refunds are issued only upon successful, timely proof.

3.3 Financial Commitment and Payment Processing

The user chooses a refundable amount:

  • Minimum: €20 per goal
  • Maximum: €3,000 per goal

Payments and refunds are processed via Stripe, Inc.; the Stripe Services Agreement and Privacy Policy apply. An non-refundable transaction fee also applies (displayed transparently before confirmation). Refunds—after validated proof—are issued only to the same payment method used for the original payment.

3.4 Evidence Review System

After the goal period ends, you must submit suitable evidence within the submission deadline. Evaluation takes place through one of three options:

a) AI-based referee: An automated process assesses whether the submitted evidence likely meets the goal criteria.

b) Internal review: A staff member manually assesses whether the submitted evidence likely meets the goal criteria.

c) External human referee (third-party referee): An independent third person named by the user assesses whether the submitted evidence likely meets the goal criteria.

Delay by third-party referee: If no decision is made on time, the AI-based referee will automatically take over. A decision must be made within 170 days of goal creation at the latest.

3.5 Evidence Scope

Before committing to a goal, we provide a framework within which evidence for each goal must be collected. This evidence framework is generally AI-generated. The specifications from the evidence scope are binding and constitute the sole benchmark for proven goal achievement.

3.6 Overview

Before payment, the user receives an overview of all settings (goal, deadlines, commitment incl. fee, referee type). The user confirms via checkbox that they have read, understood, and accepted the Terms of Use, the binding evidence scope, and Rights & Obligations. Only then is payment possible.

3.7 Checkout and Amount Due

After confirmation, checkout is enabled with payment and binding goal activation. The amount due consists of the previously chosen refundable commitment, a base fee, and a transaction fee. The base fee is €10; an additional €5 service fee applies when selecting a human referee. The transaction fee consists of 2.9% calculated on the refundable amount plus a fixed €0.30. A valid email address and the necessary payment details are required for Stripe. The purchase becomes binding only after successful payment, and the obligations associated with the goal take effect.

3.8 Refunds

The refundable amount is held until successful evaluation of the corresponding evidence scope. Upon successful goal achievement and timely, valid proof, full refund of the refundable amount is issued via Stripe. A claim to such a refund exists only with complete/timely fulfillment and compliance with all evidence conditions.

4. Right of Withdrawal and Challenge

Right of withdrawal: Consumers may withdraw within 14 days without stating reasons (period begins on the contract date). Timely dispatch of the notice is sufficient. In the event of withdrawal, all payments will be refunded no later than 14 days after receipt of the notice of withdrawal.

Extraordinary challenge: Possible if an individually defined goal was not achieved despite demonstrable efforts. Requirement: credible demonstration of proper use. The decision is made on a case-by-case basis; there is no automatic right to withdraw outside the statutory withdrawal period.

Non-fulfillment: If the goal is not completed on time or sufficient proof is not provided, the goal is deemed not achieved. In this case, the refund claim expires; the refundable amount is retained to cover service and administrative costs.

A subsequent review or refund is excluded if timely and complete goal fulfillment is not documented. In unclear cases, users may request a review by support; the final decision is at the provider’s discretion.

5. Disclaimer

The Ziele-Setzen.com platform provides organizational and motivational support for goal pursuit. It does not constitute medical, psychological, therapeutic, or legal advice. Users are responsible for setting only appropriate goals; in case of doubt, consult a physician or other qualified professional in advance.

No liability is assumed for damages resulting from failure to achieve goals, improper use of the platform, false statements by users, or insufficient evidence, nor for indirect/consequential damages or missed refunds, unless due to intentional misconduct or gross negligence. Availability or functionality may be impaired (e.g., Stripe outages, maintenance); no liability is assumed for such impairments.

If you believe an evaluation is incorrect or special circumstances apply (e.g., illness), you may request an individual review. Decisions regarding ex-post recognition or (partial) refunds are at the provider’s discretion.

7. Final Provisions

If any provisions are wholly or partially invalid, the validity of the remaining provisions remains unaffected. The law of the Federal Republic of Germany applies (excluding the UN Convention on Contracts for the International Sale of Goods). Mandatory consumer protection provisions of the user’s country of residence remain unaffected. The place of jurisdiction—where legally permissible—is the provider’s registered office; consumers may alternatively bring an action before the court of their place of residence.

The provider may amend these terms where reasonable. Users will be informed in due time about material changes; continued use after entry into force constitutes acceptance.
